  • A licence is required where the HMO has five or more unrelated people living in it and two or more separate households
  • The council sets out the standing obligations alongside the licence: fire safety measures including working smoke alarms, annual gas safety checks, electrical checks every five years, no overcrowding, enough cooking and bathroom facilities for the number living there, clean and well-repaired communal areas, and enough bins
  • Letting a licensable HMO without a licence, or allowing more occupants than the licence permits, is an offence
  • HMO use can also need planning permission, which is a separate decision from the licence

Enforcement

The council’s own page still quotes the older £20,000 and £5,000 maximum fines. The current position is a civil penalty of up to £40,000, or prosecution, and the figures on this page come from the national duties table rather than the council’s page.

These are statutory, not local. A council that has designated a scheme can use all three, and a tenant can bring the second one without the council being involved at all.

    Most applications ask for the same documents you already owe the tenant: the gas safety record, the EICR, the EPC, and the fire detection and escape arrangements for an HMO. The council’s list is the one that counts, but nothing on it will be a surprise if those are current.
